1. About these terms

These terms govern the website techwithbyron.dev and the services provided by Byron O'Connor Information Technology ("we", "us", "our"), a technology consultancy registered in the United Arab Emirates and operating from Abu Dhabi. By using this website or engaging our services, you agree to these terms. Specific engagements may be governed by a separate written agreement, which takes precedence where it conflicts with these terms.

2. Our services

We provide:

  • Technology consultancy — platform engineering, AI infrastructure, and related professional services under individual engagement agreements;
  • AI messaging and automation services — software we build and operate for business clients, which may answer and manage conversations on the client's behalf on messaging platforms such as WhatsApp, Messenger and Instagram, schedule appointments, and send service notifications;
  • Informational content — pages on this website, provided free of charge.

3. Use of this website

You may browse this website and contact us through it. You agree not to misuse the site: no attempts to breach security, no scraping that degrades the service, no misrepresentation of your identity, and no use of the site for unlawful purposes. The content of this site is for general information; it is not legal, financial, or professional advice.

4. Terms for business clients

If you are a business client using our AI messaging and automation services, the following apply in addition to your service agreement:

  • Your accounts. You connect your own messaging platform accounts (for example, a WhatsApp Business Account). You are responsible for those accounts, for complying with the platform providers' terms and policies, and for the accuracy of the business information and service details you provide to us.
  • Your customer relationships. Your customers are your customers. You are the controller of personal data in your customer conversations; we process that data on your instructions as described in our Privacy Policy.
  • AI-generated replies. Our services generate replies automatically using large language models. Replies are grounded in the business information you supply, but no automated system is perfect: you remain responsible for reviewing the service's operation, configuring escalation to a human, and ensuring communications with your customers comply with the law and platform rules applicable to you.
  • Consent and lawful messaging. You are responsible for obtaining any consent required for the messages your customers receive through the service, and for honouring opt-out requests.

5. AI messaging services and end users

If you interact with an AI assistant we operate on behalf of a business:

  • your messages are processed to answer your enquiry, manage bookings, and send expected service messages (for example, appointment reminders);
  • the business you are messaging sets the prices, policies, and appointments — the AI assistant communicates on their behalf and its replies do not constitute our independent commitments to you;
  • you can ask at any time to speak with a human at that business, or reply "STOP" to stop automated messages;
  • your privacy is protected as described in our Privacy Policy, and you can request deletion of your data as described on our Data Deletion Instructions page.

6. Acceptable use

You must not use our services to: send unlawful, harassing, or deceptive communications; send unsolicited bulk messages; infringe others' rights; distribute malware; circumvent security or access controls; or violate the terms of any messaging platform or payment provider connected to the services. We may suspend or terminate access for serious or repeated violations.

7. Intellectual property

The website, our software, and our brand assets are owned by us or our licensors. Business clients receive a right to use the services during their subscription; nothing transfers ownership. You retain all rights to the business information and customer data you supply through the services, and grant us only the licence needed to operate the services for you.

8. Availability and support

We aim for high availability but do not promise uninterrupted or error-free services. Scheduled maintenance and events beyond our reasonable control (including outages at platform, hosting, or network providers) may affect availability. Support commitments, if any, are as stated in your service agreement.

9. Disclaimers and liability

The website and services are provided "as is". To the maximum extent permitted by law, we exclude warranties of merchantability, fitness for a particular purpose, and non-infringement, and we are not liable for indirect, special, or consequential losses, including lost profits or lost business, arising from use of the website or services. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence or for fraud. Where the services are provided to a consumer, statutory consumer rights are unaffected.

10. Suspension and termination

Either party may end a service engagement as set out in its service agreement. We may suspend services immediately where required by law, where a platform provider requires it, or where there is a serious security risk. On termination, client data is handled as described in our Privacy Policy (retention and deletion) and the client's service agreement.

11. Governing law and disputes

These terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws rules. The courts of Abu Dhabi, United Arab Emirates have exclusive jurisdiction over disputes arising from these terms, except where mandatory local law grants you the right to bring proceedings elsewhere. Before formal proceedings, we ask that you contact us so we can try to resolve the issue directly.

12. Changes to these terms

We may update these terms from time to time. We will post the new version on this page with an updated "last updated" date. For business clients, material changes will be communicated in advance and may be confirmed in the service agreement.
